Getting a Guernsey Judgment Set Aside

Royal Courts - For judgments over £10,000

Application should be made to the court to have the judgment set aside, for which a court fee is payable.

Petty Debt Court- For judgments under £10,000

Contact the Magistrates’ Court Greffe.

The court will advise you of the procedure and cost. Applications to set aside can only be made if the judgment was taken in absence.

The court also requires a sworn affidavit to support the application, detailing the following aspects that may be applicable:

  • reason for absence in court at the time of judgment
    • circumstances under which the judgment became known and the steps taken to remedy the situation
    • outline of the defence to the claim

Judgments Paid Within a Calendar Month

If the principle sum is paid in full within a calendar month from the date of judgment, the judgment can be removed from our public register.

We require a letter from the Plaintiff on letterheaded paper (where possible) which states the:

  • Court Name
    • Amount
    • Date Paid in Full

Your original proof of payment can be sent by post to:

Judgments Issued in Error

We will remove judgments issued in error if we receive a letter from the Plaintiff stating the judgment was issued in error.
